On September 14, 2026, a federal court postponed implementation of the new Duration of Status (D/S) regulations that were scheduled to take effect on September 15 and prohibited the Department of Homeland Security from implementing the rule while the legal challenge continues. As a result, the new regulations are not currently in effect, and the longstanding Duration of Status framework for F-1 students and J-1 exchange visitors remains in place.
The court’s decision is preliminary and does not permanently invalidate the rule. The litigation will continue, and the federal government may seek further review. Lehigh will therefore continue to monitor developments and maintain its implementation planning so that we are prepared should the new regulations ultimately take effect.
International students and scholars should nevertheless continue to consult with OISS before making significant academic or program changes or before traveling internationally, since these decisions can have immigration implications under the existing rules as well. Faculty should continue to refer students and scholars to OISS for individualized immigration guidance.
OISS and the Office of International Affairs will follow the litigation, federal agency guidance, and NAFSA guidance closely and will keep the campus community informed of significant developments.
